Owner of Construction or Demolition Debris Recycling Facility Settles Enforcement Action for $25,000

The Illinois Pollution Control Board recently accepted the parties’ stipulation and proposed settlement in People v. Markham Transfer & Recycling, LLC, Case No. PCB 11-103, which concerned the defendant’s general construction or demolition debris recycling facility located at 2300 West 167th Street, Markham, Cook County, Illinois.

The State alleged that the defendant violated the Illinois Environmental Protection Act by openly dumping waste, conducting a waste disposal operation without a permit, disposing and storing waste at an unpermitted facility, and failing to comply with general construction and demolition debris requirements.

Under the terms of the settlement, the defendant does not affirmatively admit to the alleged violations but agrees to pay a civil penalty of $25,000.
