Illinois Pollution Control Board Releases Environmental Register for May 2013

The Illinois Pollution Control Board recently issued its Environmental Register for May 2013.  The Environmental Register features a letter from Board Chairman Thomas Holbrook, which summarizes the activity that the Board has conducted in several rulemaking dockets.  Two rulemaking dockets of particular interest are:

  1. The Board issued an order clarifying its intent regarding certain water quality standards for aquatic life uses, as well as the relationship between proposed aquatic life uses and recreational use designations in the Chicago Area Waterway System rulemaking docket; and
  2. The Board adopted amendments amendments to the Tiered Approach to Corrective Action Objectives (“TACO”) rules to include the addition of a new exposure route under TACO: the indoor inhalation exposure route.  These amendments seek to protect building occupants against vapor intrusion, which is the potential for vapors to migrate into buildings from subsurface volatile chemical contamination.

The Environmental Register also contains a rulemaking update, a summary of actions of the Board, a summary of new cases, and the Board’s calendar.
