  • Federal Appeals Court Denies Additional Immediate Relief Requested by States in Asian Carp Case

    A three-judge panel of the U.S. Court of Appeals for the Seventh Circuit recently issued an opinion in the federal Asian carp case, Michigan v. U.S. Army Corps of Engineers, Case No. 10-3891. The Court affirmed District Court Judge Robert Dow’s judgment that the plaintiffs (several states bordering the Great Lakes and others) were not entitled to a preliminary injunction—i.e., immediate relief...
