Counting down new Illinois environmental laws that took effect on January 1, 2017 is Public Act 99-0540, which provides that if specified notice is submitted, then an employer may request that the unused portion of a terminated licensee’s pesticide applicator or operator license term be transferred to a newly certified or re-certified individual.
The new law amends several sections of the Illinois Pesticide Act, 415 ILCS 60/1 et seq, which regulates the labeling, distribution, use, and application of pesticides. The new law:
–Deletes the definition of “licensed public applicator” and includes such applicators within the definition of “commercial not for hire applicator”.
–Now states that licenses and pesticide dealer registrations are valid for the calendar year in which they are issued plus two additional calendar years. A license or registration in effect at the end of the year, for which re-certification and licensure has been made within 60 days following the date of expiration, continues in force until the applicant has been notified that re-certification and licensure has been approved or denied. A licensee or pesticide dealer shall be required to be recertified for competence and knowledge regarding pesticide use at least once every three years.
–Now states that, upon an employer’s request and payment of a $10 transfer fee, the unused portion of a terminated licensee’s pesticide applicator or operator license may be transferred to a newly certified or re-certified individual with an expiration date equal to the original license.
–Changes, and in most cases increases, fees for registration and licensure.
